Erik Bledsoe LLC Terms and Conditions

1. Purpose

ERIK BLEDSOE LLC ("Company," "we," "us," or "our") provides educational content and coaching through online communities and media platforms. By using the Company website and its services ("Services"), you agree to abide by these Terms and Conditions.

2. Eligibility

To access the Services, you agree that:

  • You are 13 years of age or older.
  • You have the authority to enter into this Agreement personally.
  • You will comply with all applicable local, state, and national laws.

3. Access

  • We grant you a revocable license to access the Services, subject to compliance with these Terms.
  • Access is for personal, non-commercial use, and privileges are non-transferable.
  • Passwords must remain confidential. Any security breach must be reported immediately.

4. Acceptable Use Policy

By using the Services, you agree to:

  • Use the Services lawfully and responsibly.
  • Refrain from any fraudulent or harmful activity.
  • Not attempt to gain unauthorized access to the Services.
  • Respect intellectual property rights and avoid scraping or distributing content without consent.

5. Information on Our Services

While we strive for accuracy, we do not guarantee the completeness or suitability of the information provided through our Services. Use at your own risk.

6. User Submissions and Content

You retain ownership of your submissions ("User Content"). However, by posting, you grant us a worldwide, royalty-free license to use, display, and distribute your content.

7. Complaint Procedures

To report content that infringes on intellectual property, violates laws, or is otherwise objectionable, email support@erikbledsoe.co. Complaints must include detailed information to ensure a swift resolution.

8. Intellectual Property

All rights to the Services, including trademarks, logos, and proprietary content, belong to ERIK BLEDSOE LLC or its licensors. Unauthorized use is prohibited.

9. Privacy Policy

Your use of the Services is subject to our Privacy Policy, which explains how we collect and use your data.

10. Third-Party Interactions

We are not responsible for third-party websites or advertisements linked through our Services. Proceed at your own risk.

11. Indemnification

You agree to indemnify and hold harmless the Company, its directors, and affiliates from any claims or losses arising from your misuse of the Services or violation of these Terms.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS." WE MAKE NO WARRANTIES REGARDING THE OPERATION, RELIABILITY, OR SUITABILITY OF THE SERVICES FOR ANY PURPOSE.

13. Limitation of Liability

In no event shall the Company be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed $100 USD.

14. Dispute Resolution

Disputes will be resolved through binding arbitration, as detailed in Section 15. You waive the right to jury trials and class actions.

15. Arbitration Agreement

All disputes will be resolved by JAMS arbitration, with exceptions for small claims court. To opt out of arbitration, send written notice to support@erikbledsoe.co within 30 days of acceptance of these Terms.

16. Termination

We reserve the right to terminate your access to the Services at any time, for any reason.

17. General

  • Choice of Law: These Terms are governed by Delaware law.
  • Severability: If any provision is invalid, the remaining provisions remain enforceable.
  • Entire Agreement: These Terms constitute the full agreement between you and the Company.

This policy is a "living" document and subject to refinement and expansion in the future.

Code of Conduct

ERIK BLEDSOE LLC and its subsidiaries (herein referred to as "Erik Bledsoe LLC," "Company," "we," "us," or "our") is dedicated to providing a harassment-free experience for everyone, regardless of age, race, gender, disability, physical appearance, body size, or religion. We do not tolerate harassment of members in any form.

This code of conduct applies to all Company groups, including our community, both online and offline. Anyone who violates this code of conduct may be sanctioned or expelled from these groups at the discretion of the Company team.

Some Company groups may have additional rules, which will be made clearly available to members. Members are responsible for knowing and abiding by these rules.

Definitions

Harassment includes:

  • Offensive comments related to age, race, gender, disability, physical appearance, body size, or religion, mental illness.
  • Unwelcome comments regarding a person's lifestyle choices and practices, including those related to food, health, parenting, drugs, and employment.
  • Gratuitous or off-topic sexual images or behavior in spaces where they're not appropriate.
  • Physical contact and simulated physical contact (e.g., textual descriptions like "hug" or "backrub") without consent or after a request to stop.
  • Threats of violence.
  • Incitement of violence towards any individual, including encouraging a person to commit suicide or engage in self-harm.
  • Deliberate intimidation.
  • Stalking or following.
  • Harassing photography or recording, including logging online activity for harassment purposes.
  • Sustained disruption of discussion.
  • Unwelcome sexual attention.
  • Pattern of inappropriate social contact, such as requesting/assuming inappropriate levels of intimacy with others.
  • Continued one-on-one communication after requests to cease.
  • Deliberate "outing" of any aspect of a person's identity without their consent, except as necessary to protect vulnerable people from intentional abuse.
  • Publication of non-harassing private communication.

Policy Priorities

The Company prioritizes marginalized people's safety over privileged people's comfort. The Company team reserves the right not to act on complaints regarding:

  • 'Reverse' -isms, including 'reverse racism,' 'reverse sexism,' and 'cisphobia.'
  • Reasonable communication of boundaries, such as "leave me alone," "go away," or "I'm not discussing this with you."
  • Communicating in a 'tone' you don't find congenial.
  • Criticizing racist, sexist, cis-sexist, or otherwise oppressive behavior or assumptions.

Reporting

If you are being harassed by a member of the Company, notice that someone else is being harassed, or have any other concerns, please contact the Company team at support@erikbledsoe.co. If the person harassing you is on the team, they will recuse themselves from handling your incident. We will respond as promptly as we can.

This code of conduct applies to Company spaces, but if you are being harassed by a member outside our spaces, we still want to know about it. We take all good-faith reports seriously.

We reserve the right to reject reports made in bad faith and will protect victims' confidentiality wherever possible.

Consequences

Members asked to stop any harassing behavior are expected to comply immediately. If a participant engages in harassing behavior, the Company team may take any action they deem appropriate, up to and including:

  • Expulsion from all Company groups.
  • Identification of the participant as a harasser to other members or the general public.

Diversity

The Company welcomes and encourages participation by everyone. No matter how you identify yourself or how others perceive you: we welcome you. Contributions from everyone are encouraged, as long as they interact constructively with our communities.
